Jewish Men Dying in Jail for Ravaging Young Girls: Epstein v. Frank

We met Jeffrey Epstein over a hundred years ago.

THE DEATH in jail of Jeffrey Epstein last month recalls a very famous death of another jailed Jewish man charged (and convicted and sentenced) of crimes against a 13-year-old girl in 1913. That case, which involved only one of many rumored similar victims, involved the lethal abuse of a factory worker named Mary Phagan by the manager of the factory, 29-year-old pillar of the Atlanta Jewish community Leo Frank, who, having grown up in Brooklyn, might have seemed rather a “damn Yankee” to at least some of his neighbors of 106 years ago. Frank’s victim, unlike any of Epstein’s known victims, was murdered and, while Frank was tried and convicted and sentenced to death, his guilt continues to be vigorously contested more-than-a-century later, by the successors to the massive and distinctly Jewish campaign to win his exoneration of the offense.

The Troubling Testimony of Alonzo Mann in the Murder of Little Mary Phagan

With today’s centennial of the death by lynching of Leo Max Frank, public attention has been fixed once again on the remarkable dual murders of Mary Phagan and Leo Frank. As is fairly well-known at this point, 13-year-old Mary Phagan was murdered in the National Pencil Factory in Atlanta on April 26, 1913. Leo Frank, her boss and last person to admit seeing her alive, was convicted of the murder.

His appeals went up to the Supreme Court of the United States and his conviction upheld at every level. Frank’s appeals to the administrative agencies of the State of Georgia also brought no change. Only when Governor John Slaton, a law partner of the Frank defense team, commuted the sentence to life imprisonment was Frank’s life apparently spared. But the outrage felt in Georgia over the impropriety of the Governor pardoning a client of his own law firm on his last day in office (and widely suspected of being bribed) resulted in a band of leading Marietta men planning and executing a daring break-in at the State Prison in Milledgeville, abducting Frank and driving over the primitive dirt roads of Georgia all night to hang him in Marietta at sunrise the next day.

The astonishing murder of Leo Frank has tended to soften the public’s view of his guilt in the murder of Mary Phagan.

Leo Frank Case Stirs Debate 100 Years After Jewish Lynch Victim’s Conviction

Notorious Case Raises Thorny Questions of Race and Hate By Paul Berger Published August 19, 2013, issue of August 23, 2013.

A century ago, Cobb County, Ga., was a sleepy farming community outside Atlanta, home to about 25,000 people. Now the county is an affluent suburb with a population of 700,000, including a booming Jewish community of about 8,000 families served by four synagogues, two restaurants doling out bagels and deli food, and a Kroger supermarket with a large kosher section.

Its changed so much by the influx of new people that its almost like a fairy tale that the lynching ever occurred, said Roy Barnes, former governor of Georgia, as he sat in his wood-paneled office just off the main square in Marietta, the countys largest city and its seat of government.

But the lynching did occur, just a couple of miles from Barness law office, when an angry mob led by Mariettas elite including Barness wifes grandfather stormed a remote prison, kidnapped Leo Max Frank, brought him back to Marietta and hung him from an oak tree in what is believed to be the only lynching of a Jew in America.

Franks lynching provided the denouement for one of the 20th centurys most contentious and consequential murder trials, galvanizing both the infancy of the Anti-Defamation League and the rebirth of the Ku Klux Klan. The gruesome image of Frank dressed in only a nightshirt, his neck broken by the noose, his lifeless body dangling from a tree as townspeople rejoiced has become an iconic illustration of Southern anti-Semitism and hatred, an ugly trope that today still echoes in dark corners of the Internet.

But the story began nearly two years earlier, on August 25, 1913, when Frank was convicted of murdering Mary Phagan, a 13-year-old white girl from Marietta who worked in the factory that Frank managed. Outside the courtroom, a crowd of 5,000 celebrated the verdict, while Northern Jews including Abraham Cahan, editor of the Forverts denounced the trial as a travesty of justice.

Today, the oak tree where Frank was hung is long gone. Strip malls, the I-75 overpass and a 56-foot-tall metal hen, an advertisement for a fast-food restaurant referred to locally as The Big Chicken, have replaced the surrounding woods.

The story of the Frank trial and lynching is buried deep beneath layers of trauma, embarrassment and shame. And 100 years after Franks conviction for the murder of Mary Phagan, the debate over his guilt or innocence continues.

The case [against Frank] is not as feeble as most people say it is, said Steve Oney, a former staff writer at the Atlanta Journal Constitution whose 2003 book, And The Dead Shall Rise, on Phagans murder and Franks lynching, took 17 years to research and write.

“It was a tremendous event,” Oney said. “It’s deeply complicated with all kinds of class and race and religious undercurrents, and then there’s just the overriding question of what happened. Who killed Mary Phgan, and who lynched Leo Frank?”

“It’s a double murder mystery and a social history,” Oney added. “For some reason, these two cases were so charged with deeper implications that the entire country ultimately got caught up in it.”

Phagan took the trolley from her home near Marietta for the 20-mile ride to Atlanta on April 26, 1913, bound for the Confederate Memorial Day parade. On her way into town, she stopped by the National Pencil Factory, in Atlanta, to pick up her pay.

It was a Saturday, and Frank, the factory’s superintendent, was at work as usual. He paid Phagan the $1.20 she was owed and, according to his later testimony, she went on her way. No one recalled seeing her again that day. During the early hours of the following morning, the night watchman found her body in the factory basement.

The girl’s hair and face were covered in soot and cinders; her dress had been pulled up above her knees, and her $1.20 was missing. There was a large gash on the side of her head, and she had been strangled with a piece of cord. Two garbled notes found next to the body implicated a “long, tall, black Negro” in the murder.

Over the following weeks, the Atlanta police botched the collection of evidence and arrested several suspects, including the black night watchman and a black factory sweeper. Eventually they turned their attention to Frank, who was arrested April 29. As the drama unfolded, the city’s newspapers competed for scoop after scoop to bring the Atlanta public and, soon the rest of America, a string of often embellished and sensational stories.

There was plenty of copy to go around. The murder of Mary Phagan and the trial of Leo Frank contained all the ingredients of a blockbuster story.

Phagan, the young, pretty child of a typical lower-class Georgia family, represented all that was innocent and pure among the exploited and downtrodden families of the South. Fifty years after the Civil War —known to Georgians as the War of Northern Aggression — many families were still scrambling to get by. The pencil factory, like many Atlanta mills and factories of the day, profited off child labor.

Frank, 29, represented much of what locals despised about the North. Awkward and effete, he was born in Texas and raised in New York. Frank had a degree from Cornell University. He moved to Atlanta in 1908 to work at the pencil factory, which was part owned by his uncle, Moses Frank. In 1910 he married Lucille Selig, daughter of a prominent German-Jewish family, and together they enjoyed the fruits of Atlanta’s privileged world.

During the trial of August 1913, the star witness against Frank was the black factory sweeper, James Conley, who had initially denied to police that he knew anything about the murder. Following weeks of imprisonment and interrogation, and after changing his affidavit four times, Conley told police that Frank had murdered the girl after she resisted his advances and that Frank had asked Conley to help him move her body. Conley testified that Frank dictated the murder notes to him to throw police off Frank’s trail.

Conley gave convincing testimony and withstood three days of cross-examination. A reader of the Forverts, on August 26, could have been forgiven for suspecting that Frank was guilty. “Several witnesses testified that Frank had a corrupt and immoral character and that he consistently harassed the women and girls who worked in the factory, and these stories very much stirred public opinion against him,” the Forverts reported.

But the Forverts added that there was also a suspicion of anti-Semitism. “Many, however, say that such hatred is prevalent towards Frank because he is a Jew and he is successful,” the paper reported. “His lawyers discussed this openly in court in their defense of Frank.”

The judge was so nervous for the defendant’s safety that he asked for Frank to be kept away from the courtroom for the verdict that day. When the guilty verdict was announced, thousands who had gathered in the streets outside the courthouse cheered.

Fresh flowers, small toys and tchotchkes still adorn the grave of “Little Mary Phagan” in Marietta City Cemetery. Such is the evidence that people still make a pilgrimage up the hillside to where she is buried, surrounded by the tombstones of relatives and some of the old Marietta families that formed Frank’s lynch party.

Even today, new memorials are still being planned. On June 1, The Marietta Daily Journal ran a small news item reporting that Commander Jack Bridwell, of the Georgia Division of the Sons of Confederate Soldiers, announced that that day and every subsequent June 1 would be marked as “Little Mary Phagan Day.”

“They asked for my approval on that,” Mary Phagan-Kean, the victim’s 59-year-old great-niece told the Forward. Kean, who moved to Ellijay, 80 miles north of Marietta, last year, assented to Bridwell’s request with the caveat that Mary Phagan’s name could never be used for “prejudicial purposes.”

“You wouldn’t believe the calls I get from crazy people,” Kean said.

The Frank case has long been a magnet for anti-Semitic groups. A few decades ago, the Ku Klux Klan marched through Marietta to Phagan’s grave to protest a movement to secure a posthumous pardon for Frank.

Anti-Semitic attitudes certainly played a role in Frank’s lynching. But Kean’s family, which is firmly convinced of Frank’s guilt, denies that anti-Semitism explains his conviction.

In this respect, Kean has some support from Frank himself. Cahan traveled to Atlanta in March 1914 to visit Frank in his cell. In the fifth volume of Cahan’s memoirs, published in Yiddish in 1931, Cahan relates that Frank told him the Atlanta police were desperate for a conviction. Mary Phagan’s murder presented a huge challenge for prosecutor Hugh Dorsey, who had just come off the back of two embarrassing courtroom defeats.

“Anti-Semitism is absolutely not the reason for this libel that has been framed against me,” Frank told Cahan. “It isn’t the source nor the result of this sad story.”

Instead, Frank said, police had “taken advantage” of Frank’s Jewishness to undermine his case. They had disparaged Jews in general so “that a Negro against a Jew is believable.“

Indeed, Frank’s lynching stands out — as a white man, his lynching was the exception rather than the norm. Almost a decade earlier, 25 black people were killed and 150 injured during a 1906 race riot in Atlanta that was sparked by reports of a white woman being raped by a black man. In 1915, the year of Frank’s lynching, 21 black people were lynched, including one, John Riggins, who was hanged in South Georgia the same day as Frank.

By contrast, Jews were well integrated into Southern society. Many prominent Atlanta businessmen — the Riches, the Elsases, the Hirsches and the Seligs — were Jewish. Even in Marietta, the small Jewish community owned businesses and prospered. But Frank’s trial, conviction and appeal brought out an ugly side in the community, a side that was inflamed by the press.

Adolph Ochs, publisher of The New York Times, was the most prominent of a number of Northern newspaper owners to wage a campaign casting aspersions on the trial. The perception of Northerners interfering in Southern justice was grist for anti-Semites such as Thomas Watson, a former congressman and vice presidential candidate whose newspaper, the Jeffersonian, railed against “the Northern papers, which are owned by rich Jews.”

“This campaign of lies, abuse, defamation and race hatred gets worse and worse,” Watson wrote in a typical editorial in early 1915. “It must be costing the Chosen People a lot of money.”

While Frank was being retried in the court of public opinion, his lawyers fought to win an appeal. They argued that the hostile public sentiment that had precluded Frank from the courtroom proved he hadnot received a fair trial.

Even Conley’s lawyer, William Smith, joined Frank’s defense. When an analysis of the two notes found at the murder scene appeared to show that Frank could not have dictated them, Smith became convinced the murder could only have been the work of Conley.

Frank’s lawyers appealed all the way to the U.S. Supreme Court, where the justices found 7­–2 against Frank. His lawyers pressed on. In June 1915, they persuaded Georgia Governor John Slaton, then in his last days in office, to commute Frank’s sentence to life in prison.

Overnight, Frank was moved about 100 miles southeast to a prison at Milledgeville. The reaction was swift. A mob of thousands marched on the governor’s mansion. In Marietta, Slaton was hanged in effigy. An inmate at Milledgeville took matters into his own hands and slit Frank’s throat. But he survived.

Most Jews who know about Leo Frank believe that he was innocent. “He was wrongly accused, unjustly tried and wantonly murdered,” said Rabbi Steve Lebow of Temple Kol Emeth, in Marietta.

Lebow has waged a decades-long campaign to raise Frank’s profile and to secure a pardon. He was instrumental in erecting two plaques on the side of an office building closest to the believed site of Frank’s lynching within sight of The Big Chicken. The majority of Atlanta’s Jews have, at best, a vague knowledge of Frank’s case, if they have heard of it at all.

The last major attempt to pardon Frank, during the 1980s, was bolstered by the testimony of Alonzo Mann, a former pencil factory worker who said he had seen Conley struggling to carry Phagan’s body, alone. Mann, who was a teenager at the time of the murder, said his mother had told him to keep quiet.

The appeal was only a partial success. In 1986, the Georgia Board of Pardons and Paroles found that there was insufficient evidence to clear Frank of Phagan’s murder. Instead, the parole board pardoned Frank on the grounds that the state failed to protect him and to provide an “opportunity for continued legal appeal of his conviction.”

Frank was abducted from the Milledgeville prison the night of August 16, 1915. The scar on his neck, from the attempt on his life less than a month earlier, had barely healed. A group of armed men, thought to number about 25, had driven south from Marietta through back roads earlier that evening, in seven cars. They cut the phone lines to the prison, overpowered prison staff and whisked away Frank, still dressed in his nightshirt.

“It was a feat of some daring,” said Oney, who linked some of Marietta’s elite to the crime by researching the area’s car owners in 1915. “All told, it was a 300 miles round trip, in the dead of night, on largely unpaved roads, in Model Ts and other cars of that vintage, with flat tires and magnesium headlights you had to light with a spark device.”

The convoy arrived at a wooded grove known as Freys Gin, a couple of miles outside Marietta, in the early morning of August 17. Frank was blindfolded, his arms handcuffed and legs bound. He was hoisted onto a table, where a noose was placed around his neck. Then the table was kicked away.

Over the course of the morning, a crowd of gawkers grew around the lynch site. “The crowd was an unruly, fanatically wild mass,” the Forverts reported. “With each passing moment it became even more infused with race hatred, with a lust to kill.” When the body was cut down, a member of the crowd stomped on Frank’s face.

The doctor who examined Frank’s body later told the Forverts: “There were well-defined markings of a sole of a shoe on his nose and near his left eye. His left ear was practically torn off. Many wounds to the skull. His facial expression was one of terror through having been brutalized.”

Marilyn Hurwitz, whose grandparents owned a store in Marietta at the time, said the mood in the town was grim. Her mother recalled how a mob gathered outside the family store the night after the lynching. Hurwitz, now 82, said the family had to rush through the crowd to make it to a streetcar bound for Atlanta. Her grandfather opened his store the following day, but he did not sleep in Marietta for some time afterward, Hurwitz said.

The lynching affected the Jews of Atlanta, too. Tony Montag, whose family owned a controlling stake in the National Pencil Company, said. “My father told me it was the first time he’d ever seen his father with a gun.”

Atlanta’s German-Jewish elite now had to live in a community that included people who supported Frank’s conviction and the lynching. They coped by not talking about Frank. Montag said of his father: “If people did start talking about it in a social context, he would get up and leave the room. It was just a painful memory to him.”

The events of 1913 to 1915 threw two contradictory forces into motion in Atlanta. Frank was president of a local lodge of B’nai B’rith, the Jewish fraternal organization. His lynching galvanized the newly formed Anti-Defamation League, which went on to become the pre-eminent American Jewish organization to fight bigotry and intolerance.

A few months after Frank’s lynching, atop Stone Mountain, about 35 miles from Marietta, the reconstituted Ku Klux Klan held its first cross burning. The Klan was spurred partly by the release in 1915 of the movie “The Birth of a Nation.” But it was also bolstered by the nativist writings in Watson’s Jeffersonian and by the rising xenophobia in Atlanta over the previous two years.

Though the lynching frightened Atlanta’s Jewish community, most Jews remained in and around the city. As Atlanta’s population has grown rapidly in recent decades, the Jewish community has grown even faster.

Until recently, Cobb County had one of the fastest-growing Jewish communities in metropolitan Atlanta, which itself was among the fastest-growing communities in America. During the last population survey, in 2006, conducted by the Jewish Federation of Greater Atlanta, the community had grown 56% in the previous decade, to 120,000 Jews.

A century after Frank’s conviction, there appears to be little appetite in the community — apart from Lebow — to push for exoneration. Oney said that his 17 years of research led him to believe that Conley probably murdered Phagan, but there is enough doubt to “leave the door ajar.” So much evidence has been bungled, destroyed or lost since the murder that to be able to say with 100% certainty that Frank is innocent “would give me a power of clairvoyance that I don’t have,” Oney added.

Today, the trial and the lynching seem unimaginable in Atlanta. But they were unimaginable a century ago, too.

When Cahan visited Frank in 1914, he told Frank that he wanted to send a telegram to New York explaining to readers what it is like to be an innocent man sentenced to death. Cahan said that Frank smiled and took from his pocket a pencil and a piece of card.

“The whole story seems like a dream to me,” Frank wrote. “It seems to me that I’m observing it from the side; it belongs to somebody else, not me. For the moment, I feel no fear at all.”

The Murder of Little Mary Phagan: Mary Phagan: Amazon.com: Books

The Murder of Little Mary Phagan, by Mary Phagan Kean is, in my opinion, insulting not just to Leo Frank who was unjustly convicted of her murder and dispicably lynched by a sick mob, but also insulting to a little girl tragically murdered. This book is a typical example of what a person can make of historical fact and turn it into historical fiction.

There is no denying that all of the subsequent events to Mary Phagan’s death, somewhat obscures the loss of life to this little girl but the narcissitic way, in my opinion, that Mary Phagan Kean portrays her anscestor and herself, is in some way, creepy and sensational. Nobody buys this book because they want to know about Mary Phagan Kean. They buy it because they think Mary Phagan Kean has some greater insight into the events of Mary Phagan’s death and it’s aftermath. However, clearly she does not and instead tries to sew a tale not really including all of the historical facts.

Several poor examples among others are saying that just because her grandfather got hoodwinked by Conley, similar to the jury, (was it hoodwinked or Anti Semitism?) and believes in Conley’s innocence says nothing about the facts of this case. Only that her grandfather is gullible and Conley a good talker. Her father’s lack of opposition to Frank’s subsequent lynching is much much more chilling and revealing about the aleged underlying nature of Kean’s book.

As an attorney and as a former assitant district attorney, I can tell you that just because all of the appeals through the State and Federal court system led to denials of a new trial, one after another, does not speak to Franks guilt, at all really, but rather to the procedural manner in which Judge Roan handled the trial.

In the Yawning Darkness on Sunday, April 27, 1913

After Old Newt Lee, the African-American National Pencil Company nightwatchman, punched the timeclock in Leo Frank’s second floor business office at 3:01 o’clock a.m., he went down to the stygian basement for the purpose of using the racially segregated Negro toilet. When he completed his business and went to check the large sliding wooden and steel door of the cellar service ramp, something out of the ordinary appeared faintly in the gloom. As Lee held his smoky lantern closer, it appeared to be a dead child, who had been horribly mauled. Lee in a state of shock, briskly ran to the head of the basement and climbed up two flights to call his superintendent Leo Frank, but after 8 minutes of trying to reach him, no one answered, so Newt called the Atlanta police station.

The grizzly discovery launched an investigation that began precisely at 3:24 AM on Sunday, April 27, 1913, when the graveyard shift call-officer, W.F. Anderson was notified by telephone from a frantic Negro about the horrific discovery. A squadcar filled with officers and Britt Craig (Atlanta Constitution Journalist) was immediately dispatched by Anderson moments later. What happened next, was revealed at the Leo Frank trial more than three months later, as first responders described in detail what events occurred upon their arrival.

At dawn, after the police failed to contact Leo Frank by phone all night long, they finally got through to him at 7:00 am and rushed over to his residence and carried him directly to the morgue for identifying the dead body. After Leo Frank claimed to be unsure about the identity of the dead girl, police officers drove him to factory, in an effort to have him pinpoint the approximate time of Phagan’s arrival via his accounting books.

“Saturday, April 26, 1913 at 12:03 o’clock p.m.”

Inside Leo’s business office, he opened his payroll ledger and told the officers that Mary Phagan had arrived at about 12:03 pm on Saturday, April 26, 1913, asking for her pay and upon receiving it left. Frank went on to tell the police he did not leave his office until 12:45 p.m.

Monday, April 28, 1913 at 9:00 a.m.

The next day, Monday morning, April 28, 1913, Leo Frank would change the time of Phagan’s arrival to his office from 12:03 pm, to between, “12:05pm to 12:10pm, maybe 12:07pm” (State’s Exhibit B, Leo Frank Trial Brief of Evidence, 1913).

Leo Frank Anniversary May 8th: The Fulton County, Georgia, Coroner, Paul Donehoo’s Inquest for the Mary Phagan Murder Investigation, Wednesday, April 30, 1913 to Thursday, May 8, 1913

The procedural machinations of the official Mary Phagan murder investigation wasted no time in efforts regarding uncovering the material circumstances of the crime.

The Coroner’s Inquest

Presided over by the Fulton County Coroner Paul V. Donehoo were a half-petite jury of prominent men from the community, who opened the coroner’s inquest investigation on Wednesday morning, April 30, 1913.

The coroner’s inquest began shortly after nine o’clock after the jury was sworn under oath. The empaneled tribunal in total consisted of seven men (1 + 6), the coroner and six inquest jurymen: (1.) H. Ashford, foreman, (2.) Glenn Dewberry, (3.) J. Hood, (4.) C. Langford, (5.) John Miller, (6.) C. Sheats, (7.) Judge of the Inquest Jury, The Fulton County Coroner, Paul Donehoo.

Within the two cross-examination sessions of Leo Frank, he was very specific that he did not use the second floor bathroom ALL DAY when he testified under oath at the coroner’s inquest — not that he didn’t remember — but that he DID NOT USE the bathroom on April 26, 1913. He appeared to be distancing himself (verbally and mentally) from the bathroom area of the second floor, which was located in the metal room. There were no other bathrooms on the second floor of the National Pencil Company, except in the metal room (Defendent’s Exhibit 61). This was thought of as a throw-away detail until it became a link in the case.

Caught in a Lie: The Perjury of Lemmie A. Quinn

Lemmie QuinnA controversial new development occurred concerning Leo M. Frank’s murder timeline alibi about him never leaving his office on April 26, 1913, between noon and 12:45 p.m. Leo Frank said he had forgotten for the first week of the murder investigation to bring forward Lemmie A. Quinn, foreman of the metal room, a key witness at the coroner’s inquest and later at the Frank trial. He was criminally impeached during the appeals after the revelation that he was offering bribes to witnesses to change their stories. At the coroner’s inquest, Lemmie Quinn came forward to provide testimony that sounded contrived and did not pass the common sense test.

Quinn told the coroner’s inquest jury, he had went back to the pencil factory and specifically into Leo M. Frank’s office at 12:20 to 12:25 to talk about a baseball bet with Mr. Herbert George Schiff, but Schiff was not supposed to be at the factory at all that day because it was a state holiday and everyone was given the day off.

Herbert G. Schiff later prided himself at the Leo Frank trial for never missing a day of work in five years (BOE, Herbert Schiff, 1913) except once unintentionally during a disastrous flood. Leo Frank gave the false impression that Schiff missed work that day to support the Quinn appearance.

Several employees close to Leo Frank would later provide a cacophony of contradictory information about Schiff.

If Lemmie Quinn was at the NPCo factory on Confederate Memorial Day, Saturday, April 26, 1913, at 12:20 p.m., asking Leo Frank, “Where is Herbert G. Schiff?” and intimating he had not come to work yet, the average person in 1913 was sarcastically asking why Herbert Schiff was NOT at work on a state holiday in the shuttered factory?

The coroner’s inquest jury saw right through it, and ostensibly the falsified testimony of Quinn was meant to shrink the plausible time Leo M. Frank would have to bludgeon, rape, and strangle Mary Phagan by fifteen minutes from formerly 12:02 p.m. to 12:35 p.m., to 12:02 p.m. to 12:19 p.m. However, the importance of Lemmie A. Quinn’s manufactured testimony was it added eyewitness testimony strength to Leo Frank’s alibi that he never left his office from at least noon to 12:35 p.m.

Lemmie Quinn’s perjury shrunk Leo M. Frank’s unaccounted time on that fateful Saturday, but it still left the time frame Mary Phagan arrived at Frank’s office wide open and unaccounted for.

Three Separate and Distinct Mary Phagan Arrival Times Would Later Become Four

According to Leo Frank:

1. Mary Phagan arrived in his second-floor business office at 12:03 p.m. on April 26, 1913–this information was given to detectives on Sunday, April 27, 1913, in Leo Frank’s office.

2. Mary Phagan arrived in his second-floor business office at “12:05 pm and 12:10 p.m., maybe 12:07 p.m.” according to Leo Frank in State’s Exhibit B, given to the police on Monday, April 28, 1913.

3. Mary Phagan arrived in his second-floor business office at 12:10 p.m. on April 26, 1913–Frank gave this information at the coroner’s inquest.

At the time of the coroner’s inquest, Leo Frank had provided three different times that Mary Phagan had arrived in his office.

Conclusion of the Coroner’s Inquest and Jury

Coroner Paul Donehoo and his inquest jury of six men empaneled, questioned over one hundred factory employees and dozens of other various associated people.

The coroner’s inquest combed through the factory to examine the layout and permutations of the murder.

The weeklong inquest and testimony provided under oath left strong suspicion directed upon Leo M. Frank when Thursday, May 8, 1913, the Mary Phagan Inquest drew to a close.

At 6:30 p.m., the jury went into executive session to hear the testimony of Dr. J. W. Hurt, county physician, on the what had happened to Mary Phagan shortly before her death and what was the likely cause. The doctor addressed the jury for twenty minutes.

Donehoo convened to hear the jury findings:

“We, the coroner’s jury, empaneled and sworn by Paul Donehoo, coroner of Fulton County, to inquire into the death of Mary Phagan, whose dead body now lies before us, after having heard the evidence of sworn witnesses, and the statement of Dr. J. W. Hurt, County Physician, find that the deceased came to her death from strangulation. We recommend that Leo M. Frank and Newt Lee be
held under charges of murder for further investigation by the Fulton County grand jury.

Coroner and Inquest Jury Verdict: The Coroner Approved the Unanimous Finding of the Inquest Jury

The coroner and his inquest jury of six men together voted unanimously 7 to 0 recommending Leo M. Frank be bound over for murder and investigated further by a grand jury of twenty-three men, which ironically included four Jews.

Coroner Paul Donehoo ordered that Leo Frank be bound over for murder and Newt Lee was to be held as a material witness.

Still yet to be uncovered was who wrote the murder notes that appeared to be written by a Negro in Ebonics.

Police Delivered the News to Leo Frank and Newt Lee

Deputy Plennie Minor delivered the unanimous verdict of the coroner’s inquest jury to Leo M. Frank, who was being held in the infamous Atlanta Police Tower. Frank was sitting perusing a local daily newspaper, Atlanta Constitution, May 8, 1913, at the time at the time of the message. When Deputy Plennie Minor approached Leo M. Frank and told him about the unanimous verdict of the inquest jury, which had ordered that Frank be held for murder and for a more thorough investigation by the grand jury.

Newt Lee slumped his head dejectedly when the bad news was delivered to him. However, Leo Frank insolently replied that it was no more than he had expected and continued crackling away and folding the big sheets of his newspaper.

In total, more than two hundred witnesses, factory workers, and affiliates had been subpoenaed providing sworn testimony at the Inquest.

What stood out the most from all the inquest testimony was that Leo Frank specified he never went to the bathroom that day, and he held onto that position for 3.5 months until he made a startling revelation during his trial on August 18, 1913.

One can’t help but wonder if the grand jury transcript was also purged in an effort to expunge some interesting testimony that led to the unanimous indictment of Leo Frank by twenty-one jurors, including four Jews.

100 years ago today the trial of the 20th century ended its first week, shedding brilliant light on the greatest murder mystery of all time: the murder of Mary Phagan. And you are there.

THE MOST IMPORTANT testimony in the first week of the trial of National Pencil Company superintendent Leo Frank for the murder of Mary Phagan was that of the night watchman, Newt Lee (pictured, right, in custody), who had discovered 13-year-old Marys body in the basement of the pencil factory during his nightly rounds in the early morning darkness of April 27, 1913. Here at the Mercury we are following the events of this history-making trial as they unfolded exactly 100 years ago. We are fortunate indeed that Lees entire testimony has survived as part of the Leo Frank Trial Brief of Evidence, certified as accurate by both the defense and the prosecution during the appeal process.

Almost all of the information published today about the Frank trial has two characteristics in common: 1) it is stridently pro-Frank with little pretense of objectivity, and 2) it is derivative meaning that it consists of little more than cherry-picked paraphrases and interpretations of what witnesses said, and reporters and investigators discovered, during those fateful days. To say that much crucial information is left out or glossed over by the partisan writers of today is a vast understatement. We aim to correct come of these intentional omissions in this exclusive series.

The courtroom scene

Well begin with the entire testimony taken during direct and cross examination of Newt Lee. There had been attempt to frame Lee through the medium of a planted bloody shirt before the trial began, an act almost certainly committed by pro-Frank forces. But subsequent events proved that Lee was entirely innocent, and by the time of the trial he was not under any suspicion whatever, and therefore had no known motive to lie. Here are his exact words (emphasis ours, some paragraph breaks added for increased readability):

NEWT LEE (colored), sworn for the State.

On the 26th day of April, 1913, I was night watchman at the National Pencil Factory. I had been night watchman there for about three weeks. When I began working there, Mr. Frank carried me around and showed me everything that I would have to do. I would have to get there at six oclock on week days, and on Saturday evenings I have to come at five oclock.

On Friday, the 25th of April, he [Leo Frank] told me Tomorrow is a holiday and I want you to come back at four oclock. I want to get off a little earlier than I have been getting off.

A review by Mark Cohen of Steve Oneys And the Dead Shall Rise

IN HIS 742-page magnum opus about the Leo Frank case, author Steve Oney shamelessly fails to inform the reader of who ultimately solved the Mary Phagan murder mystery in 1913.

On Monday morning, April 28, 1913, Leo Frank was taken to the Atlanta Police Station for routine questioning during the critical first 48 hours of the Mary Phagan murder investigation. In an interrogation room, Leo Frank was flanked by his two elite lawyers, Luther Z. Rosser and Herbert Haas, and surrounded by a team of police, staff, and detectives. Leo Frank made a deposition concerning his whereabouts during Confederate Memorial Day, Saturday, April 26, 1913, and about his brief encounter with Mary Phagan minutes after high noon.

Leo Franks statement was stenographed by a government magistrate named Mr. February, and the statement became part of the official record at the Leo Frank trial, registered as States Exhibit B (Leo Frank Trial Brief of Evidence, 1913). Leo Frank specifically stated that Mary Phagan entered his second floor office on Saturday, April 26, 1913 between 12:05 pm and 12:10 pm, maybe 12:07 pm. Leo Frank also repeatedly told the police and detectives that he never left his office on April 26, 1913 between twelve noon and 12:45 pm. However, Leo Franks timeline alibi would dramatically change at his trial (which took place from July 28 to August 21, 1913) on August 18, 1913, when he mounted the witness stand.

At the trial of Leo Frank for the murder of Mary Phagan, a 14-year-old girl named Monteen Stover who formerly worked at the National Pencil Company testified she went there to collect her pay envelope inside Leo Franks office on Saturday, April 26, 1913, at 12:05 p.m. and found Leo Franks office completely empty. Monteen Stover described waiting inside the office for five minutes, until 12:10 pm when she left because she thought the factory might have been deserted. If Monteen Stover was telling the truth, she had inadvertently broken Leo Franks alibi concerning his whereabouts on that fateful day. What was ironic about Monteen Stovers testimony is that she was a positive character defense witness for Leo Frank, unlike 19 of his other employees and associates whose testimony suggested Leo Frank was a lecherous, licentious, lascivious, and libertine boss.

Leo Frank specifically mentioned, on August 18, 1913, the issue of Monteen Stover finding his office empty on Saturday, April 26, 1913 between 12:05pm and 12:10pm and in doing so, Leo Frank himself solved the Mary Phagan murder mystery.

Leo Frank mounted the witness stand at 2:15 pm to make an unsworn courtroom speech to the judge and jury on the record. During Leo Franks four-hour trial statement, he refused to be examined or cross examined by defense and prosecution counselors, but he answered the question everyone wanted to know by directly responding to the testimony of Monteen Stover about why his office was empty on April 26, 1913 between 12:05 pm and 12:10 pm. Leo Frank contradicted his earlier statement to the police and explained this five minute absence with a never before heard admission that, during those crucial moments, he might have unconsciously gone to the bathroom in the Metal Room.

It was an astonishing, jaw dropping, and spine-tingling admission by Leo M. Frank that left everyone in the courtroom perplexed, because there was only one bathroom on the second floor and it was located inside the Metal Room the real scene of the crime. Leo Frank not only put himself in the Metal Room where all the forensic evidence suggested Mary Phagan had been murdered, but he put himself in the specific location at which Jim Conley testified he found the dead body of Mary Phagan.

The newfangled explanation delivered by Leo Frank on August 18, 1913 at 2:45 pm to the judge and jury was considered the equivalent of a murder confession, because the states prosecution team spent the entire duration of the four-week-long trial proving Leo Frank murdered Mary Phagan in the Metal Room on April 26, 1913 between 12:05 pm and 12:10 pm.

The Metal Room was down the hall from Leo Franks office, and was the place Mary Phagan had toiled for more than a year at a wage of 7 and 4/11th cents an hour. The Metal Room was where Leo Frank went to use the bathroom each and every day, as he worked down the hall in his second floor office at the front section of the National Pencil Company. When Leo Frank went to the bathroom each day between the years time between the Springs of 1912 and 1913 that Mary Phagan was employed, he had to immediately pass by her work station within a matter of feet but Leo Frank denied even knowing Mary Phagan at the trial, and it became an incriminating point of contention against him.

At the trial Jim Conley reported that he discovered the dead body of Phagan in the metal department (Metal Room) bathroom at the behest of Leo Frank. Conley stated that Leo Frank asked him to move her body to the basement furnace where garbage was normally placed before being incinerated. In the aftermath of Jim Conleys refusing to complete the job of stuffing Mary Phagan into the furnace for $200 (and thereby destroying the evidence), Conley instead agreed to write the death notes pinning the bludgeoning, rape and strangulation of Mary Phagan on a tall, dark, and slim black man named Newt Lee, the factory night watchman and security guard who had worked at the factory for less than three weeks. The death notes were found next to the body of Mary Phagan, and they describe her going to make water in the only place she could make water, which was the bathroom in the Metal Room on the second floor. There was no bathroom accessible on the first floor and the one in the dark, dingy basement was for Negroes Only.

On Monday morning, April 28, 1913, a factory employee named Robert P. Barret discovered a bloody tress of hair tangled on the steel handle of his lathe in the Metal Room, and moments later a 5-inch-wide fan-shaped blood stain on the floor of the Metal Room in front of the girls dressing room next to the bathroom. Barret testified about the forensic evidence he found, and it pointed to the same conclusion: the Metal Room had been the scene of a heinous crime of violence followed by a very poor clean-up job. All of the evidence presented at the trial pointed to the Metal Room as the real scene of the crime.

Jim Conley saying he found Mary Phagan dead in the Metal Room bathroom at the behest of Leo Frank and Leo Frank saying he might have unconsciously gone to the bathroom in the Metal Room at the same time he originally told the police that Mary Phagan was in his office (States Exhibit B), and at the same time Monteen Stover said Leo Franks office was empty, resulted in the case coming together at the murder trial with absolute precision.

Leo Frank entrapped himself beyond escape at his trial on August 18, 1913, at 2:45 pm.

Many have asked how many times in the annals of United States legal history has the accused made an admission that amounted to an unmistakable murder confession at his or her own trial?

If there are any doubts about Leo Franks August 18, 1913 murder trial confession, consider reading the March 9, 1914, Atlanta Constitution jailhouse interview of Leo Frank, in which he reconfirms his trial testimony about a Metal Room bathroom visit, specifically responding to Monteen Stovers testimony about his office being empty between 12:05 p.m. and 12:10 p.m. on Saturday, April 26, 1913.

The solving of the Mary Phagan murder mystery is found in the fact that Leo Frank made the equivalent of a public murder confession at his trial. This is documented in the official Leo Frank Trial Brief of Evidence, 1913, and the Georgia Supreme Court Case File on Leo Frank, 1913, 1914. No appellate tribunal called to review the Leo Frank trial brief of evidence from 1913 to 1915, and from 1982 to 1986 disturbed the unanimous verdict of the judge and jury originally made in August of 1913. One may also read between the lines of appeasement concerning the Anti-Defamation League (ADL) sponsored Leo M. Frank posthumous pardon without exoneration issued on March 11, 1986.

By cherry-picking and misrepresenting large parts of the case, a subtext is inserted in Oneys book that an innocent and well-educated Ivy League Jew named Leo Frank was ensnared by the real culprit, a semi-literate and drunken stumble-bum, the African-American factory sweeper Jim Conley.

Oney downplays the fact that Leo Frank and Jim Conley had a personal relationship that was a bit too close for comfort. Leo Frank would often goose and jolly with James Jim Conley at the factory. Leo Frank also managed Jims contracts as Conley had a side business selling watches at the factory and even ripped off Mr. Arthur Pride who testified about it at the trial. In 1912, even though Jim Conley had just served a one month sentence for drunk and disorderly behavior, Leo Frank took him back at the National Pencil Company in mid-October.

Leo Frank knew for a fact Jim Conley could write, but kept this information in confidence until it was too late. Leo Frank never said a single word about Conley to the police during the early days of the Mary Phagan murder investigation, even though the death notes were clearly written in Ebonics, and there were only eight African-American employees, out of 170 employees in total, working at the National Pencil Company factory. Jim Conley worked at the National Pencil Company in various capacities for two years and had even done some written inventory work for Leo Frank.

Steve Oney never addresses why Leo Frank knowingly refused to tell the police Jim Conley could write.

What Steve Oney fails to elaborate fully for the reader is the most grotesque subplot of the bludgeoning, rape and strangulation of Mary Phagan: its pinning on the African-American night watchman Newton Newt Lee. Lee was ordered by Leo Frank on Friday, April 25 to arrive at work an hour early, 4:00 pm, on the infamous day of April 26, 1913 so Leo Frank could go to a ball game with his brother-in-law, Mr. Ursenbach.

Oney points out in his book that weeks after Leo Frank and Jim Conley were arrested, the police arranged for them to confront each other face-to-face over the murder. Jim agreed, but Leo refused. Oney never answers the question why an innocent White man would refuse to confront an African-American man, accusing him of strangling a 13-year old White girl in the context of the White racial separatist south of 1913, where the word of a Black man would almost never be taken over the word of a White man.

Though Steve Oney claims he spent 17 years of his life traveling the country to research and write this colorful and thesaurus-enriched book, his analysis is shallow and myopic at best. Oney tends to wear blinders and drives with the emergency brakes on during his epic 700+ page journey, and, as a result, he does not plumb the depths of the case, leaving the reader truly frustrated, unsatisfied, and unfulfilled. No real modern forensic analysis is applied to this case by Oney despite the hundreds of documents surviving into the 21st century, including crime scene and autopsy descriptions by police, detectives, undertakers, and physicians. Oney does, however, fill his book with every crackpot theory ever advanced on behalf of Leo Franks defense, regardless of whether or not the inclusions stand up to even minimal scrutiny.

One of the biggest frauds Oney perpetuates was originally fabricated by the tabloid-style journalist Pierre van Paassen in his book To Number Our Days, published in 1964. In this 404-page work, van Paassen spends less than two pages (pp. 237-8) recalling an incident that happened in 1922, at a time when he was in Atlanta, Georgia, working as a journalist for the Atlanta Constitution, and investigating the then almost decade-old Leo Frank Case.

To Number Our Days, by Pierre van Paassen, chapter: Short Stand in Dixieland, page 237, line 27:

The Jewish community of Atlanta at that time seemed to live under a cloud. Several years previously one of its members, Leo Frank, had been lynched as he was being transferred from the Fulton Tower Prison in Atlanta to Milledgeville for trial on a charge of having raped and murdered a little girl in his warehouse which stood right opposite the Constitution building. Many Jewish citizens who recalled the lynching were unanimous in assuring me that Frank was innocent of the crime.

I took to reading all the evidence pro and con in the record department at the courthouse. Before long I came upon an envelope containing a sheaf of papers and a number of X-ray photographs showing teeth indentures. The murdered girl had been bitten on the left shoulder and neck before being strangled. But the X-ray photos of the teeth marks on her body did not correspond with Leo Franks set of teeth of which several photos were included. If those photos had been published at the time of the murder, as they should have been, the lynching would probably not have taken place.

Though, as I said, the man died several years before, it was too late, I thought, to rehabilitate his memory and perhaps restore the good name of his family. I showed Clark Howell the evidence establishing Franks innocence and asked permission to run a series of articles dealing with the case and especially with the evidence just uncovered. Mr. Howell immediately concurred, but the most prominent Jewish lawyer in the city, Mr. Harry Alexander, whom I consulted with a view to have him present the evidence to the grand jury, demurred. He said Frank had not even been tried. Hence no new trial could be requested. Moreover, the Jewish community in its entirety still felt nervous about the incident. If I wrote the articles, old resentments might be stirred up and, who knows some of the unknown lynchers might recognize themselves as participants in my description of the lynching. It was better, Mr. Alexander thought, to leave sleeping lions alone. Some local rabbis were drawn into the discussion and they actually pleaded with Clark Howell to stop me from reviving interest in the Frank case as this was bound to have evil repercussions on the Jewish community.

That someone had blabbed out of school became quite evident when I received a printed warning saying: Lay off the Frank case if you want to keep healthy. The unsigned warning was reinforced one night, or rather, early one morning when I was driving home. A large automobile drove up alongside of me and forced me into the track of a fast-moving streetcar coming from the opposite direction. My car was demolished, but I escaped without a scratch.

Van Paassens account of these events that allegedly happened more than four decades before is faulty in several particulars. Dental X-ray forensics were in their infancy in 1913, and never used in Georgia for any murder case until countless years after Leo Frank was hanged. Is it Mr. Harry Alexander or Henry Alexander? And why would the attorney who represented Leo Frank during his numerous appeals say Leo Frank didnt have his murder trial yet? Leo Frank was not lynched on his way to trial or prison in late June 1915; he was lynched 170 miles away in Marietta on August 17, 1915. Bite marks on Mary Phagans left shoulder and neck? None of the numerous examinations or autopsies of Mary Phagan conducted by the undertaker, police, detectives, and physicians reported in the official record and newspapers mention any bite marks on Mary Phagans shoulder, neck or anywhere else on her body. Van Paassen also claims an attempt was made on his life by forcing him into a head-on collision with a streetcar in which his car was demolished, but he escaped without a scratch all this in 1922 when there were virtually no safety features to speak of in automobiles.

The definitive book on the Leo Frank case has yet to be written. Perhaps its time for Steve Oney to re-read and carefully study the 1,800-page Georgia Supreme Court file on Leo M. Frank, and put out a new edition of his book without all the easily-verified misrepresentations, fabrications, half-truths, omissions, and sloppy research.

THE CENTURY-OLD cold case Mary Phagan murder mystery the violent rape and murder of a Christian teenager Mary Phagan and the subsequent lynching of the convicted killer, Jewish businessman Leo Frank has now been conclusively solved by scholars using the extensive 1913 official investigation and trial records.

In this once-in-a-lifetime event, the publishing, mass media, and academic establishments who have for decades promoted the conspiracy theory that anti-Semites framed Frank for the crime because he was Jewish have been proven to be wrong by the statements of Leo Frank himself.

At the murder trial, an admission was made by the defendant, when he testified from the witness stand, amounting to a confession. If this is indeed true, then the logical question is:
